The preparation and handling of food is important to not only the NSW Food Authority but to the reputation of all food businesses in Uralla Shire, from a weekend market stall to a restaurant. Your business has fundamental legislative requirements under the A/NZ Food Safety Standard & Food Act 2003 & Regulations. Part of Uralla Shire Council’s role is to inspect, at least annually, all food premises for compliance, education and assistance regarding legislative or regulatory requirements.


Food Business Information

New Business or Existing
All businesses that sell, prepare, serve packaged foods, transport and store food items are required to be registered with the NSW Food Authority and have a nominated Food Safety Supervisor for each food premises. Your business must be approved to be established or to be constructed under the NSW State Environmental Planning and Assessment Act 1979.

Market Stalls
An application to Uralla Shire Council & approval to operate a market stall must be obtained prior to the stall being operated. Any food that is prepared for sale must be manufactured and/or stored in premises that meet the minimum requirements of the Food Act 2003, the Food Standards Code and Australian Standard 4674:2004 Design, Construction and Fit-out of Food Premises. The premises must be approved for use under the NSW State Environmental Planning and Assessment Act 1979 by Uralla Shire Council. Temporary Events or Charities
Any event that has food for sale must notify the NSW Food Authority. Charities or Fundraisers will need to register their intended date and stall notice to the NSW Food Authority prior to the date.

Home Based Businesses
Any food that is prepared for sale must be manufactured and/or stored in premises that meet the minimum requirements of the Food Act, 2003, the Food Standards Code and Australian Standard 4674:2004 Design, Construction and Fit-out of Food Premises. The premises must be approved for use under the Environmental Planning and Assessment Act, 1979. Application, Inspections & Penalties
Applications to start or construct a new Food Business can be found using the link below or contacting the Technical Services Department of Uralla Shire Council on 6778 6300.

Inspections
An inspection of all premises that prepares, sells or stores food is required each year.

Annual Administration Fee - $200
This fee includes an annual inspection and all reporting requirements to the NSW Food Authority. This fee belongs to the premises not the operator of the premises; therefore it would not be recharged if there was a change in premises operation.

Inspection Fee - $125
This fee is required if:
a) A repeat inspection is required due to a non-compliance issue.
b) There is a change of premises operator.
c) If a non compliance issue is found after an inspection based upon a complaint.

This fee will not be charged if the inspection has been requested by the premises operator, as this type of inspection will be considered advice provision.

Issue of Improvement Notice - $330
An Improvement Notice will be issued if a direction to complete or rectify repairs is not completed by a set date. Should you wish to challenge the Improvement Notice, escalation to a Prohibition Order could be a possibility. A Prohibition Order could result in the closure of your business until satisfactory rectifications are achieved meaning a loss of revenue for your business.

Penalties
There are significant fines for failing to notify as a food business before trading commences. Since April of 2004, fines have been imposed, up to $55000 for a single business or $275000 for a corporation found to be in breach of Section 100 of the NSW Food Act 2003.

Food Safety Supervisors
A Food Safety Supervisor is required for each food premises. Registration to the NSW Food Authority is no longer a requirement. Each appointed Food Safety Supervisor needs to be trained in certain nationally recognised Units of Competency and hold a FSS Certificate.

The aim of a Food Safety Supervisor is to prevent individuals becoming ill from food poisoning as a result of incorrect handling and preparation of food. Statistics show that incorrect food handling practices in retail food businesses account for more than one-third of foodborne illness outbreaks in NSW, costing the community hundreds of millions of dollars each year in healthcare and lost revenue. Having a Food Safety Supervisor gives your food businesses a better level of onsite protection for food safety and gives consumers peace of mind when dinning or buying food in Uralla Shire.

Examples of Businesses include restaurants, cafés, takeaway shops, caterers, bakeries, pubs, clubs, hotels and supermarket hot food sales.

Am I required to have formal training to prepare or serve food?
The Food Safety Standard 3.2.2(3) requires all food handlers to have training and knowledge in food hygiene matters.


Complaints

Complaints about a food business or food related illness should be sent to council@uralla.nsw.gov.au. Whilst every possible action is taken to prevent illness or sickness in food preparation, Uralla Shire Council will investigate complaints made about food businesses in a private and confidential manor. All investigations are kept between the Uralla Shire Council and the NSW Food Authority.
