Planning Strategies
What is a Planning Strategy
A Planning Strategy is a document that is intended to provide a broad direction for the future growth and development of a local government area.

The topics that might be addressed within a Planning Strategy include the natural environment, physical infrastructure, economic development, urban and rural development and land-use planning.

Planning Strategies may affect the entire region or be specific to key sites or areas.

What is the process for preparing a Planning Strategy
Planning Strategies provide a framework to guide Council’s vision for the community and the long term direction for land use development. Planning Strategies consider many current and emerging issues such as:

  • environmental, social and economic sustainability
  • changing demographic trends and infrastructure requirements
  • planning for growth with regard to housing and development
  • economic development and employment opportunities
  • cultural and heritage maintenance and preservation

A Planning Strategy is a public document which provides the opportunity for government agencies and the community to have input into strategic planning. Community consultation is an important part of this process and when a draft Planning Strategy is being prepared the community will be asked to provide input and feedback.

The community consultation process will usually include notices in the local newspaper, public information sessions, brochures and website information. Council will consider all feedback received prior to endorsing the final strategy document.

Why have Planning Strategies
Planning Strategies developed by Council for the community are designed to effectively manage growth, development, the natural and built environment and to ensure the economic viability of the Shire and New England region.

New England Development Strategy - The New England Development Strategy was prepared for the New England Strategic Alliance Councils. The Alliance comprises the four local government areas (LGAs) of Armidale Dumaresq, Guyra, Uralla and Walcha. The Strategy outlines key land use policies and principles for the four LGAs, and provides the planning context for the preparation of local environmental plan (LEP) provisions. The Strategy has a time frame of approximately 25 years, to 2032.

New England Development Strategy

Uralla Draft Heritage Study - At Council’s Ordinary meeting on 17 December 2012, it resolved to advertise the draft heritage study for public submissions during the period Monday 7 January 2013 until Monday 4 February 2013 and to advise all affected owners individually.

Planning Controls – What are they?
A Local Environmental Plan (LEP) is the principal legal document for determining land use and controlling development at the local level. Land uses and standards are determined by both State and local objectives for the future of the area. LEPs control and guide proposed development using land use zones and development standards. They also contain a range of provisions such as those relating to heritage, subdivision, flooding and drinking water catchments. A LEP is made by Council in consultation with the community, and approved by the Minister for Planning, according to the Environmental Planning and Assessment Act 1979 and Regulations.

The Uralla Local Environmental Plan 2012 is a principal LEP which means it has been made in a standard form prescribed in the Standard Instrument (Local Environmental Plans) Order 2006. The maps which accompany the LEP, such as zoning and lot size must also conform with the standard technical requirements for LEP maps.

The Uralla Local Environmental Plan 2012 is now in force following its gazettal on Friday 23 March 2012.

Planning Proposals

Planning Proposal One
The amendment was gazetted on 9 August 2013. The outcomes and objectives of this amendment were:

  1. To provide protection for the high conservation values (flora and ecological community) located on Lot 1 DP 1168505 Devoncourt Road, Uralla and Lots 2 – 7 DP 1168505, Panhandle Road, and Uralla (DP 1168505).
  2. To correct drafting errors in Uralla Local Environmental Plan 2012.

Planning Proposal Two - Land Classification
The proposed amendment was accepted by Council on 26 November 2012, with a Gateway Determination being received from the Department of Planning & Infrastructure on 22 February 2013. Public consultation will take place for a period of 28 days after a hertiage study has been completed. The intended objectives and outcomes of the proposed amendment is to reclassify land at Bingara Road (Lot 1 DP 1062924) and Muirhead Street (Lot 1 DP 1165352), Bundarra and Queen Street (Lot 30 DP 793510) and Kliendienst Road (Lot 613 DP 755846), Uralla from ‘community’ to operational’.

This planning proposal was exhibited for the period Wednesday 31 July 2013 to Wednesday 28 August 2013. A Public Hearing has been set for Wednesday 16 October 2013, 10.00am at the Uralla Council Chambers, 32 Salisbury Street, Uralla.

Planning Proposal Three – Elizabeth Avenue Rezoning
The proposed amendment was accepted by Council on 25 March 2013, with a Gateway Determination being received from the Department of Planning & Infrastructure on 13 September 2013. Public consultation will take place for a period of 14 days after a consultation with the NSW Office of Environment & Heritage – Flood Plain Unit has been completed. The intended objectives and outcomes of the proposed amendment are to rezone the land known as Lots 2 & 20 within Section 33 of DP 759022 bounded by Elizabeth Avenue, Maitland and Park Streets, Uralla from RE1 Public Recreation to R1 General Residential as the land is no longer recognised as public open space.

Development Control Plan
A Development Control Plan (DCP) is a detailed guideline that illustrates the controls that apply to a particular type of development or in a particular area. A Development Control Plan refines or supplements a regional environmental plan or local environmental plan and is made according to the Environmental Planning and Assessment Act 1979.

The Uralla Development Control Plan 2011 was adopted by Council on 19 December 2011, and became operational at the date of gazettal of the Uralla Local Environmental Plan 2012. Generally the purpose of the DCP is to indicate to developers what level of detail is required with certain types of applications and what standards are sought with the design of certain developments.

Section 94 Contributions Plan
A Section 94 Contributions Plan is a document which details council’s policy of obtaining development contributions as a means of funding local infrastructure and services that are required as a result of new development. These contributions are imposed as a condition of development consent under the provisions of section 94 of the Environmental Planning and Assessment Act 1979.

Contributions are determined by analysing the cost of existing infrastructure, existing demand, anticipated growth and the cost of works required to meet the demands created by a development.
